Nemeth Law’s Raising the Bar series presents: Employee Leave Policies that Work on May 20

Detroit, Mich. – April 30, 2015 –Raising the Bar, an educational series raising employer awareness of current issues in employment and labor law and offered by Detroit-based management side labor and employment law firm Nemeth Law, P.C., returns May 20 to discuss best practices for developing leave policies and procedures that work. Nearly half a dozen state and federal laws can come into play when an employee is absent, according to Patricia Nemeth, founder of Nemeth Law, P.C.

“It can be harder to manage employees who are absent than employees who actually show up to work,” Nemeth said.

It’s not just about understanding when and how different laws apply, though, it’s also about putting policies and procedures in place that work well with the laws, Nemeth continued.

“Earlier this year, the Sixth Circuit Court of Appeals, which includes Michigan, ruled that an employer’s statement in a handbook that employees ‘are’ covered by, and eligible for, leave under the Family and Medical Leave Act (FMLA) prohibited the employer from later arguing that one of its employees was not eligible for leave – even though the employee did not meet the FMLA’s eligibility requirements,” Nemeth said. “From this ruling and juggling the Pregnancy Discrimination Act (PDA), Americans with Disabilities Act (ADA), workers compensation, short term disability and long term disability, it’s no wonder this is the topic we get the most questions about.”

Employee Leave Policies that Work will help employers understand how to manage absent employees and how to develop leave policies and procedures that work. Specific topics to be covered include:

• Defining notice requirements for employees and employers under the FMLA, ADA, PDA and workers compensation
• Criteria on medical examinations and certification of fitness for duty requirements
• Best practices for managing intermittent leave and for controlling abuse

Chamber Leads Action-Packed Month of Business Attraction Events to Market Detroit Region’s Assets

The Detroit Regional Chamber’s Business Attraction team recently concluded an action-packed month in March, crisscrossing the globe to promote the Detroit region’s assets to national and international prospects at numerous high-profile events.

On March 23-24, the Chamber partnered with the Michigan Economic Development Corporation (MEDC) to attend the SelectUSA Investment Summit in Washington, D.C., which brings together investors from across the world, national economic development organizations, government officials and others working to facilitate investment in the United States. The trip included 61 one-on-one meetings, 37 of which were with companies tied to agriculture, alternative energy, defense and manufacturing that are interested in foreign direct investment in Michigan and the Detroit region.

Angela Fortino, business development representative for the Chamber, met with representatives from 10 different countries, including Chile, China, Germany, Japan, Iceland, Israel, Italy and Taiwan. Overall inquiries, she said, focused on Detroit’s bankruptcy, Michigan’s tax structure and the economic health of Southeast Michigan.

“A lot of people were surprised that Michigan is a right-to-work state, so we need to do a better job at promoting that to outside investors,” she said.

For the summit, the state of Michigan and its partners developed a prospectus for real estate opportunities. According to SelectUSA and the U.S. Department of Commerce, it was the only document like it that was prepared for attendees. In the future, the Chamber and its partners plan to create robust marketing to coincide with the summit and ancillary events for foreign direct investment and business attraction.

Members of the Michigan delegation that attended this year’s event included Ann Arbor SPARK, the city of Southfield, Clayton & McKervey, Flint and Genesee Chamber of Commerce, Macomb County and Miller Canfield.

Attracting Global Business Expansion with Mission to France and Italy

The Chamber’s Vice President of Economic Development Maureen Krauss traveled to Europe to meet with companies in France and Italy during a two-week mission March 7-21. The two-pronged trip included attendance at the MIPIM conference in Cannes, France, which brings together over 20,000 investors from 89 countries for four days of networking and discussion on investment opportunities in communities across the world. It was the first conference of its kind attended by the Chamber, Krauss said.

“Our attendance at MIPIM was about getting the Detroit region in the minds of key decision makers,” she said. “When a company wants to invest $100 million dollars somewhere, we want to make sure they understand our story and what opportunities may exist in Southeast Michigan.”

The second half of the mission took place in Italy and included collaborative efforts with the MEDC to call on businesses and other contacts during a fast-paced four-day schedule that culminated with meetings with 14 companies. All of the companies previously expressed interest in expanding into the Detroit region through contact with the Chamber or its partners.

Krauss said meeting with companies and obtaining a better understanding of their needs was far more beneficial than reaching out via phone call.

“It’s very important to see a company’s operations in order to obtain a better understanding of what decision makers may be considering in Michigan. Even a good website won’t help you with that. It’s about touring advanced manufacturing operations and getting a feel for the type of facility a company wants to build here,” she said.

“Any good sales person will tell you a one-on-one meeting beats a phone call any day. Often you have to ask for the sale — which in this case is arguing for the Detroit region — and it’s much more impactful to do that in person,” Krauss added.

Many of the companies Krauss met with specialize in manufacturing and office space development and are “intrigued” with the revitalization taking place in the region, she said.

“When these companies hear about Detroit, they hear the region. They aren’t looking at borders between communities. They view all of Southeast Michigan and they are very curious about what’s going to happen here next.”

That’s why, Krauss said, it’s important to continue to market the region with one unified voice and present its assets with a collaborative outline to foreign investors.

Walsh College Student Dubin Reaches Bloomberg Hall of Fame

Walsh College Master of Business Administration/Master of Science in Finance (MBA/MSF) student Aaron Dubin has earned a place on the Bloomberg Aptitude Test (BAT) Hall of Fame list for March 2015 with a third-place performance on the highly competitive exam for the Americas region.

Dubin’s final score of 710 placed him in the 99th percentile out of more than 250,000 people who have ever taken the BAT. Bloomberg L.P., a world leader in financial data analytics and news, hosts the 100-question, two-hour online test that measures students’ aptitudes for careers in finance.

Consisting of eight sections, the BAT includes math, analytical reasoning, analysis of charts and graphs, news analysis, economics, global markets, analysis of financial statements, and investment banking.

The BAT helps students and recent graduates connect with financial employers worldwide. The test was developed in partnership with premier financial institutions and university faculties around the world.

Students who take the BAT uncover their strengths across a range of finance, business, career and personal competencies and gain insight into their suitability for careers in business and finance.

“The BAT provided a good opportunity to reinforce and support my classes at Walsh. It allowed me to apply the concepts and skills I’ve learned in class to situations that resemble business applications in the real world, which makes it easier for me to see the big picture,” said Dubin.

“Right now I’m working in information technology and my current goal is to move into quantitative finance or large systems design for a rapidly growing enterprise,” he added. “I see an opportunity to fuse the financial and managerial skills I’m building at Walsh with the technical skills I’ve acquired and continue to develop.”

Dubin, whose undergraduate degree is in computer science, said he was encouraged that the exam showed his skills were growing through his studies at Walsh and that he was “becoming more competitive in a bigger crowd” of students nationally.

After taking the test, students can enter their scores anonymously into the BAT Talent Search, a tool used by employers to identify candidates for entry-level roles in business. Employers can view student profiles anonymously and may elect to contact students with testing profiles complementary to their company’s available career opportunities.

SAE World Congress Provides Business Attraction Backdrop to Promote Detroit Region’s Assets

Last week, the Detroit Regional Chamber and the Michigan Economic Development Corporation hosted eight international delegations attending the SAE World Congress at Cobo Center to promote the Detroit region. As part of the week’s activities, the Chamber’s Business Attraction team met with 200 representatives from automotive-related companies looking for opportunities to export and/or expand into the U.S. market.

Maureen Krauss, vice president of economic development at the Chamber, said many of the delegates visited Detroit for the first time and were curious to learn about the regional market. Delegations included the Austria Auto Delegation, Business Upper Austria, China Technology Consortium, Foshan, Czech Republic, Mexico, Taiwan and the Torino Chamber of Commerce. The Detroit Regional Chamber congratulates Henry Ford Hospital on 100 years of serving the residents of Detroit and Southeast Michigan. JPMorgan Chase Global Cities Conference Outlines Detroit Investment as Key to Region’s Growth

The Detroit Regional Chamber  joined regional civic and business leaders in a day focused on strengthening the city’s global trade competitiveness during the inaugural Global Cities Detroit conference on April 22. Chamber President Sandy Baruah participated in a panel with Detroit Economic Growth Corporation President and CEO Rodrick Miller focused on current efforts to promote trade and investment in the city and strategies that can be implemented with surrounding counties to grow global talent and capital.

The conference’s keynote speakers included Mayor Mike Duggan; Nancy McLernon, president and CEO of the Organization for International Investments; and Bruce Katz, vice president and founding director of the Brookings Metropolitan Policy Program and co-director of the Global Cities Initiative. Michigan Future Schools Column Calls for Greater Diversity in the Classroom

A recent column published by Patrick Cooney, college success manager at Michigan Future Schools, calls on local government and education leaders to provide equal access to education opportunities for Detroit’s residents as a viable solution to improve the city’s struggling schools.

Cooney suggests that “good schools” require a greater mix of incomes and races attending school together. In order to keep Detroit on a sustainable path toward long-term economic recovery, Cooney says state and city leaders must implement housing policies that encourage a greater mix of incomes, followed by progressive education policies that push for schools to be more demographically representative of the entire community. The column follows the recommendations of the Coalition for the Future of Detroit Schoolchildren to reform Detroit Public Schools presented to Gov. Rick Snyder in March. New WIN Report: Post Secondary Training Demand On The Rise

Southeast Michigan to add more than 7,500 new middle-skill jobs by 2019

DETROIT, Mich. – The Workforce Intelligence Network (WIN) today released a report focused on middle-skill jobs (those that pay more than $15 per hour and require more training than a high school diploma, but do not require a bachelor’s degree) in southeast Michigan, highlighting the importance of higher education and training. Employers in the region will add more than 7,500 new middle-skill jobs for workers by 2019.

With a shifting economic landscape, post-secondary training is now more important than ever. There will be negative job growth in the coming years for jobs that currently only require a high school diploma. By 2019, the total number of employees in jobs that require no post-secondary training will drop by more than 18,000, while jobs that do require post-secondary education are expected to add 20,000 jobs in the coming five years. Thirty-seven percent of total job growth will be in middle-skill jobs.

“Employer demand remains strong, with middle-skill jobs paving the way to a bright future with higher education and even more lucrative employment,” said Lisa Katz, executive director, WIN. “Projections show that over the next five years there will be no aggregate growth in employment for jobs that solely require a high school diploma or less, establishing a clear need for additional training and/or education after high school to be a competitive worker in today’s job market.”

Detroit, Ann Arbor, Troy, Flint and Southfield are among the top cities in Michigan for middle-skills job demand.

Training for many of the top growing middle-skill jobs is available through southeast Michigan’s community colleges, which currently provide training in all but one of the top ten middle-skills fields. Many Michigan Works! agencies can also help workers pay for training in high demand fields.

However, depending on the job, graduates in 2014 may or may not have been sufficient in meeting employer demand that year. For some occupations, 2014 graduates outpaced employer demand, but for others there were not nearly enough new graduates to meet employer needs.

“With southeast Michigan’s future relying on an educated workforce with high-wage and high-skill jobs, higher education and training are fundamental for long-term sustainability for our economy,” Katz added.

Gina Torielli Receives Volunteer of the Year Award From United Way of Washtenaw County

Torielli is a Senior Counsel in Dykema’s Ann Arbor office. Her practice focuses on taxation and public finance, and in that capacity she has advised many nonprofit organizations and governmental entities on issues relating to tax exemption, tax-exempt financing and state and federal tax issues.
